Data User Agreement

Luquillo LTER Data User's Licence and Agreement , Acknowledgement, and Disclaimer

LUQ  data and metadata is released under public domain: CC BY – Attribution.

Licence:
The LUQ LTER grants you (hereafter, Licensee) a license to use the data and documentation for academic, and research purposes only, without a fee.

Licensee may make derivative works. However, if Licensee distributes any derivative work based on or derived from the data and documentation, then Licensee will:
    1. Notify the LUQ LTER designated contact (typically the investigator who collected the data) regarding its distribution of the derivative work,and
    2. Clearly notify users that such derivative work is a modified version and not the original data and documentation distributed by the LUQ LTER, and the support of NSF Grants DEB-129764 (2012-2014), DEB-0620910 (2006 to 2012), DEB-0218039 (2002 to 2006), DEB-0080538 (2000 to 2002), DEB-9705814 (1994 to 2000), and/or  DEB-9411973  BSR-8811902 (1988 to 1994) in any publications using the data and documentation. See suggested text.

    3. Send to the addresses below(1) & (2), two reprints of any publications resulting from use of the data and documentation.

Any Licensee wishing to make commercial use of the data and documentation should contact the LUQ LTER, c/o ITES, to negotiate an appropriate license for such commercial use.
Commercial use includes:

   - integration of all or part of the data and documentation into a product for sale or license by or on behalf of Licensee to third parties or
   -  distribution of the data or documentation to third parties that need it to utilize a commercial product sold or licensed by or on behalf of Licensee.

Conditions of Use

The consumer of these data (“Data User” herein) has an ethical obligation to cite it appropriately in any publication that results from its use. The Data User should realize that these data may be actively used by others for ongoing research and that coordination may be necessary to prevent duplicate publication. The Data User is urged to contact the authors of these data if any questions about methodology or results occur. Where appropriate, the Data User is encouraged to consider collaboration or coauthorship with the authors. The Data User should realize that misinterpretation of data may occur if used out of context of the original study. While substantial efforts are made to ensure the accuracy of data and associated documentation, complete accuracy of data sets cannot be guaranteed. All data are made available “as is.” The Data User should be aware, however, that data are updated periodically and it is the responsibility of the Data User to check for new versions of the data. The data authors and the repository where these data were obtained shall not be liable for damages resulting from any use or misinterpretation of the data. Thank you.

All data and metadata are made available "as is". The Data User holds all parties involved in the production or distribution of the Data Set harmless for damages resulting from its use or interpretation.
